Section 15
Service of deadline, notice etc.
: (1) Notwithstanding anything written in the prevailing law, if any notice, deadline, bond, etc. has to be served on any company, director, shareholder, debenture holder or employee in relation to the business of the company or matters related to the company, at the registered office of that company If such notice, term, bond, etc. is submitted or if it is registered and sent by post or if it is sent by telefax, email, telex or other similar electronic device kept in such office, it will be deemed to have been duly served. If any notice, deadline, bond question etc. cannot be complied with, the relevant company, director or employee can be informed about it by broadcasting or publishing the relevant notice in radio, television or national level daily newspaper. The notification made in that way will be considered as having received the information.
(2) Notwithstanding anything written in the prevailing law, if any director, shareholder, debenture holder or any employee of the company is served with any deadline, notice, bond question etc. on behalf of the company or any authorized officer or court in matters related to official work, such director, shareholder or employee If his telex, email, telefax address has been given, it can be registered and sent by post to such address and in the case where such address is not given, it can be sent by registered post and if such notice, deadline, bond etc. has been duly served.
(3) Notwithstanding anything else written in this Act, when the company provides information or information to be sent to any shareholder, debenture holder or director in accordance with this Act, or when receiving any information from them, they shall use electronic means of communication as provided in the rules of the company or with their consent. It can be sent to the electronic communication address provided. However, the shareholders, debenture holders or directors who do not agree to receive such notice or information through electronic communication shall be sent such notice or information by post or other reliable means.
